A California federal district court has set a Settlement Disposition Conference for June 6, 2023, in a class action lawsuit alleging defects in infotainment systems of certain Cadillac and Escalade vehicles. The parties advised in an April 5, 2023, filing that they have reached a settlement in principle and requested until May 30, 2023, for submission of the settlement-related documents.
As alleged in the most recently filed Complaint, GM:
. . . failed to disclose a material and dangerous defect to its customers who purchased or leased 2013 to 2017 Cadillac ATS, SRX and XTS vehicles and 2014 to 2017 Cadillac CTS, ELR and Escalade vehicles equipped with GM’s “Cadillac User Experience” touch screen display (the “CUE System” or “CUE”) (collectively, “Class Vehicles”). Among other things, the CUE System controls the vehicle’s climate, navigation, audio/Bluetooth/communications, and back-up camera. GM’s conduct is especially egregious because the defective CUE Systems pose serious safety risks.
The Complaint further asserts the alleged defect in the CUE system “causes it to spontaneously delaminate, bubble or crack in a ‘spider-web’ formation,” which in turn causes the unit to stop functioning properly. The plaintiffs raised claims including violation of state consumer and business laws, breach of warranty, and unjust enrichment.
