On May 17, 2021, class action attorneys filed a lawsuit that accuses BMW of deceptively marketing their 2021 430i and 430i xDrive cars. Specifically, the lawsuit claims BMW falsely stated the vehicles have LED headlights with cornering lights. Cornering lights are a safety feature that assists drivers with going around dark corners. However, the lawsuit claims the vehicles do not actually have cornering lights and drivers may dangerously rely on the non-existent safety feature.
The lead Plaintiff, Garry Porter, states he purchased a 2021 BMW 430i from BMW in Delray Beach, Florida. He claims his vehicle had a Monroney Sticker that stated it come with cornering lights. But he subsequently received a letter from BMW stating his car did not actually have cornering lights. When he contacted BMW client relations, BMW refused to provide any assistance.
Mr. Porter states he would have paid less for the vehicle, or not purchased it at all, if he had known the car did not actually have cornering lights.
The lawsuit alleges BMW’s conduct violates the New Jersey Consumer Fraud Act. Plaintiff filed his lawsuit on behalf of himself and all others similarly situated. He seeks monetary damages, attorney fees, and other relief allowed by law.
The lawsuit is Porter v. BMW, 2:21-cv-11316, and is pending in the District of New Jersey. Miller Shah LLP represents the lead Plaintiff and putative class.
